This Release and Waiver of Liability is to Youth Sailing resource (a Minnesota non-profit corporations that owns the fleet that includes but not limited to, Flying Scotts, Montgomery 17, Johnson J scow, Phantom, Butterfly, Hobie 16, 25’ Sidelman “Cheers”, and auxiliary equipment) for Participant’s involvement in the following: Activity: The permitted activities are to sail and/or race sailboats and/or participate on or near water on other vessels provided and/or used by Youth Sailing resources.

In executing this Release, the Participant (and if the Participant is under the age of 18, co-signed by their Parents/Guardians), hereby freely, voluntarily, and without duress execute this Release under the following terms:

1. RELEASE AND WAIVER: The Participant, (and if the Participant is under the age of 18, co-signed by their Parents/Guardians), do hereby release and forever discharge and hold harmless Youth Sailing Resources, and their successors and assigns for any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arises or may hereafter arise from Participant’s in the above mentioned Activity.

2. ASSUMPTION OF THE RISK: The Participant understands that the Activities may be hazardous to the Participant, especially if focus and attention to instructions, rules and regulations is not maintained. Participant hereby expressly and specifically assumes the risk of injury or harm resulting from the Activities.

3. Participants acknowledge that they have read, understood and will comply with Youth Sailing Resources Sailboat Operational Policies and Rules.
